Electronic Payment Disclosure and Authorization

Definitions: As used in this Agreement, the following terms are defined. "You" or "your" means the person who accepts and agrees to the electronic payment towards the various entities that may use our system. These electronic payments may also be facilitated by a third party service provider.

Terms and Conditions:


The following terms and conditions apply to your use of Hamer Enterprises "eVENUE" ticketing and payment system(this website). Your use of Hamer Enterprises "eVENUE" ticketing and payment system constitutes your agreement to these terms and conditions.

For each item that is paid, a separate service fee may be charged. This service fee will be disclosed to you, prior to submitting any payment.

Our system will attempt to send out an email copy of any payment transacted through our system, and/or digital representations of any tickets acquired. However, it is your responsibility to insure that your email provider or client is properly configured to receive our email messages, sent from [email protected]

In addition, if any credit card or bank transactions fail to be processed due to inaccurate or out-dated billing information, you will be expected to pay any associated NSF Fees, and accept responsibility for any additional late charges associated with failure to make a timely payment. If payments are made using your bank account for an ACH or Electronic Check transaction, Hamer Enterprises will not assume any responsibility for invalid or incorrectly entered financial information.

Canceled, Postponed, Rescheduled, or Moved Events


Occasionally, events may be canceled, postponed, rescheduled, or moved to a different venue:

If the event is canceled: Hamer Enterprises the provider of eVenue, shall not be responsible or liable for any refunds that might arise due to an event cancellation. All refunds will be the sole responsibility of the Event Organizer. Moreover, if refunds are authorized by the Event Organizer the refunds will be issued to the original method of payment used at time of purchase, once funds are received from the Event Organizer. In those instances where an Event Organizer contemplates the need for a refund [or a credit] the Event Organizer will provide the said refund or will provide You with an electronic message which will provide the details by which You can affect either a refund. In all circumstances refunds will be provided via the same payment vehicle by which a ticket was originally acquired. However, in some instances this method of refunding may not be available, therefore an alternate mechanism for affecting the refund may be utilized by the Event Organizer. Under no circumstances shall Hamer Enterprises be responsible or liable for any refund.

If the event is postponed, rescheduled, or moved: Your ticket(s) (including any additional add-ons or upgrades, such as parking) are still valid, and no further action is required. However, the Event Organizer may approve refunds, or the option to choose between a refund or a credit, for the event; any refund and/or credit policies are determined on an event-by-event basis by the Event Organizer, and may be subject to limitations set by the Event Organizer. If the Event Organizer approves refunds and/or credits, the Event Organizer will send You a notification explaining your options, and You may submit a request for a refund or credit. Alternatively, You may simply keep your ticket(s) to the postponed, rescheduled, or moved event.

If your event is canceled, postponed, rescheduled, or moved, the Event Organizer will attempt to contact You to update You on the status of the event, and inform You of any refund, credit, or exchange procedures. For exact instructions on any particular canceled, postponed, rescheduled, or moved event, You will need to check strictly with the event information online from the Event Organizer or contact the Event Organizer directly via the contact information which will be on the Confirmation Notice You will receive when the ticket(s) are initially purchased.

Hamer Enterprises nor the Event Organizer shall be liable for travel or any other expenses that You or anyone else incurs in connection with a canceled, postponed, rescheduled, or moved event.

Refunds, Credits, and Exchanges


All sales are final and refunds are only allowed in limited circumstances, as explained in this section and the Canceled, Postponed, Rescheduled and Moved Events, section above. Before purchasing tickets, carefully review your event and where applicable, the seat selection. Policies set forth by Event Organizers generally prohibit eVenue or Hamer Enterprises from issuing exchanges or refunds after a ticket has been purchased, or for lost, stolen, damaged, or destroyed tickets. Tickets therefore cannot be replaced if they are lost, stolen, or damaged.

Refunds - If your event is eligible for refunds by the Event Organizer it shall be the sole responsibility of the Event Organizer to provide such funding and issue the refunds determined by the Event Organizer. In no event will expedited shipping charges, merchandise purchases, membership fees, or any other amounts be refunded.

If a refund is issued, it will be processed to the original method of payment used at the time of purchase, and must be for the original and full purchase amount. Refunds cannot be issued to a different credit or debit card (this includes refund requests made through any future self-service options).

In the event that a Full Refund cannot be issued back to the method of payment used at the time of the purchase (for example if the account is closed, or the Refund is Declined by the bank) then the method of refund must be determined and coordinated directly with the Event Organizer, which would most likely be done via the issuance of a "Paper Check".

If the Event Organizer agrees to provide a partial refund, then the method of refund must be determined and coordinated directly with the Event Organizer, which would most likely be done via the issuance of a "Paper Check".

Please note that any available seating maps may only approximate a specific venue’s layout. Moreover, these seating maps are subject to change at any time by the Event Organizer, and refunds are not allowed if the seating map is updated, if additional seats / rows are added, or if seats change as a result of a venue change after purchase.

The Event Organizer, may occasionally offer tickets at a discount after the original on-sale date, and will not refund the difference between the original price and the sale price.

Credits - commonly referred to as "Store Credit"
The Event Organizer may provide the option to request a credit for canceled, postponed, rescheduled, or moved events; if so, the Event Organizer will send You a notification, and You can submit a request for credit. Credits can only be provided/authorized by the Event Organizer. Credits may be applied toward the purchase of eligible event tickets and ancillary purchases (such as parking, etc) at the same venue (or, in some cases, at one of a number of venues designated by the Event Organizer) during the timeframe specified by the Event Organizer. Credits cannot be used for; third-party tickets, ticket insurance, or gift cards. The Event Organizer will determine which future events, venues, and ancillary purchases are eligible, as well as the amount of the credit (including any potential promotional amount). In all instances, the amount of the credit will be determined by the Event Organizer and as such, will be provided via the original payment mechanism utilized for acquiring the ticket(s). In those instances where You have requested to receive credit, and upon authorization by the Event Organizer, You will receive notification of this credit via an electronic medium determined by the Event Organizer which will also include the terms and conditions by which the credit can be used.

Credits are non-transferable, may not be sold, are not redeemable for cash, and may not be combined with other promotions. Credits may not be applied to previously placed orders and may not be redeemed to purchase tickets for the same event as the tickets in your original purchase for which You accepted the credit.

Please note that, if the Event Organizer offers You a choice of either a refund or a credit, You cannot receive a partial refund; whatever selection You make (i.e., refund or credit) will apply to your entire order, and cannot be split between refund and credit. Any and all requests for a refund or credit are final and cannot be changed once initiated.

Merchandise - All merchandise purchases are final, and in no event will there be refunds, exchanges, or credits for merchandise purchases.

Chargebacks and Other Refund Prohibitions - You agree that You will not attempt to evade, avoid, or circumvent any refund prohibitions in any manner with regard to tickets You purchased. Without limiting the generality of the foregoing, You will not contact us to seek a refund or exchange from us when eVenue is prohibited from providing one by the Event Organizer, and You will not dispute or otherwise seek a "chargeback" from the company whose credit card or other method of payment You used to purchase tickets from the Hamer Enterprises eVenue website. Should You do so, your tickets are subject to immediate cancellation by the Event Organizer. As a result, You may be declined from making any future purchases.

Unauthorized Transactions:


Your liability for unauthorized transactions are defined by Federal law. To this end, Federal law limits your liability for any fraudulent, erroneous unauthorized transaction from your bank account or credit card account based on how quickly you report it to your financial institution. As a general rule, you should report any fraudulent, erroneous or unauthorized transactions to your bank no later than 60 days after the questionable transaction FIRST appears on your bank account statement. You should contact your bank for more information about the policies and procedures that apply to your account and any unauthorized transaction, including any limits on your liability.

Registering / Setting up a Profile


The Hamer Enterprises "eVENUE" ticketing and payment system may allow you to make payments from either your bank account or your credit card. In order to use some of the more comprehensive payment functions such as saving your payment methods in a "Digital Wallet" or storing an online history of your payments or purchased items, then you must become a registered user of Hamer Enterprises "eVENUE" ticketing and payment system. However, registration is not required to use the system.

Agreement Changes:


Hamer Enterprises’ in conjunction with the Event Organizer may, at their mutually agreed discretion, change the above Terms and Conditions as it relates to the use of the Hamer Enterprises "eVENUE" ticketing and payment system at any time without notice. If any change is found to be invalid, void or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any other changes or the remainder of these Terms and Conditions.

YOUR CONTINUED USE OF YOUR AUTHORIZED BANK ACCOUNT OR AUTHORIZED CREDIT CARD AS A PAYMENT METHOD WITHIN THE Hamer Enterprises "eVENUE" TICKETING AND PAYMENT SYSTEM IS DEEMED AS AN ACCEPTCANCE OF ANY CHANGE OF THESE TERMS AND CONDITIONS.
